Terms of Service

These terms and conditions apply to all contracts established with Spirit of OM GmbH. By placing your order, you accept the following terms and conditions. Terms and conditions of the customer deviating from our terms and conditions are not valid, unless we expressly agree to them.

 

Delivery / Prices / Shipping costs / Offers

We deliver within the Federal Republic of Germany as well as within Europe. The delivery takes place within 1-5 working days from reception of your complete and faultless order, unless otherwise agreed upon or in the item description a different delivery time is specified.

The Spirit of OM delivers free shipping within Germany from 250 € order value.

Shipping is by GLS, DPD, DHL or Post.

All prices are a total amount in Euros, as they contain all price components as well as the legal sales tax.

In addition to the prices quoted, we charge per order the shipping costs (gross) stated in the following list:

Switzerland, Norway and other EFTA or third countries: Please note that The Spirit of OM delivers without German VAT. We have no influence on the country-specific VAT rates and possibly customs duties in third countries, which may be levied. The customer bears any fees himself. Please inform yourself in your respective country. (Franking 20, duty unpaid, untaxed)

Conclusion of contract / contract language / correction of input errors

With the presentation and promotion of articles in our online shops, our catalogue or other advertising materials, we make no binding offer for the sale of certain items. A contract is only concluded when we accept your order by a declaration of acceptance or by the delivery of the ordered items. You can order by phone, letter, fax, e-mail or on the online shop by inserting the desired items in the virtual shopping cart and sending the order with the items put into the shopping cart (click on the button "Buy") and it will be sent to us.

After receiving your order on the online shop, you will automatically receive an e-mail that documents your submitted offer (order). This e-mail only confirms that the order has been received by us; a contract is not yet concluded. An effective contract only comes into effect when we accept your offer by request for payment after order submission, order confirmation by e-mail or telephone or by delivery of the goods within five days.

The contract is concluded exclusively in German or English.

You can correct input errors before submitting your order using the technical means made available in the online shop as well as the usual functions of your keyboard / mouse. You can also cancel the process at any time by closing the browser window. By clicking on the "Buy" button you have made a binding order (offer); Input errors cannot be corrected afterwards.

 

terms of payment

You have the choice between the following payment methods:

Invoice
Within Germany you pay after receiving the invoice, by bank transfer within 14 days. Due invoices must be paid before new delivery. Spirit of OM GmbH reserves the right, after result of the address and credit check, to demand method of payment by cash in advance.

Prepayment
For orders outside of Germany, Spirit of OM GmbH requires (as long as not otherwise agreed) payment in advance.

Immediate Transfer

PayPal
You pay directly through your PayPal account. After submitting your order you will be redirected to PayPal and pay by releasing the order value.

If you are in default of payment, then Spirit of OM GmbH is entitled to charge dunning fees in the amount of € 5.00. In addition, the customer must undertake (in the event of late payment) all causes due to outstanding claims within appropriate measures, the costs for recovery of: including procedural cost compensation, default interest at statutory levels, expenses, costs of debt collection (including costs of a licensed collection agency and a lawyer) and processing costs.

 

Retention of title

Until full payment, the delivered goods remain the property of Spirit of OM GmbH. The purchase contract becomes effective only when goods are delivered.

 

Exchange and return policy

The statutory warranty provisions apply. All items purchased from Spirit of OM GmbH can be returned within 14 days of reception without giving any reason. In the period around Christmas from 01.12.2022 to 15.01.2023 you are entitled to an extended right of return. The purchase contract becomes effective upon reception of the goods by your approval. If you do not return the goods within the period of approval or inform us otherwise, the approval is deemed to have been granted. The goods must be unworn on return and in perfect condition. Fitting is possible. The return must be franked to the following address:

Collect on Delivery shipments will not be accepted. The exchanged goods must be sent postage paid. In the case of deteriorated goods through further use, we reserve the right to demand compensation for damages. In the event of a justified complaint, we will refund the goods and postage. After your approval, you also have the following right of revocation.

 

Cancellation

Withdrawal

You can cancel your contract within one (1) month without giving reasons, in writing (e.g., By letter, fax, or e-mail) or - if in the case before the deadline - by returning the goods. The period begins after reception of your intentions in a formal text letter, but not before reception of the goods by the recipient (in the case of recurrent delivery of similar goods not before receiving the first partial delivery) and not before fulfilment of our information obligations in accordance with §312c Abs.2 BGB in Connection with §1 Abs.1,2 and 4 BGB-InfoV and - in the case of ordering via our website or by email - §312e para. 1 sentence

1 BGB in connection with §3 BGB-InfoV, however, before the purchase contract has become binding on you by your approval of the purchased item (see §3 of the Terms). In order to maintain the cancellation period, a timely dispatch of the revocation of the goods is sufficient.

Returns:

In the case of an effective cancellation, the mutually received benefits and any benefits (e.g. interest) is surrendered. If you cannot give us back the service received in whole or in part or only in a deteriorated condition, you may have to pay us compensation. With the release of things, this does not apply if the deterioration of the item is solely due to its examination, as is possible in a store. Incidentally, you can avoid the obligation to pay compensation for deterioration caused by the intended use of the item by not using the item as your own property and refraining from anything that could impair its value. Goods that can be shipped by parcel can be returned at your expense and risk. Non-parcelled goods will be picked up by a freight forwarder commissioned by us. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the goods, for us with their reception. 

 

Special Instructions:

The right of revocation does not apply to contracts of delivery of goods that were made according to your specification or are clearly tailored to personal needs or that are not suitable for their return due to their nature or can spoil quickly or whose expiration date would be exceeded, as well as contracts for the supply of audio or video recordings or software, provided that you have unsealed the supplied sound, image or data media (e.g. MC, CD, video, DVD, CD-ROM).

Exclusion of the right of
withdrawal According to § 312g paragraph 2 no. 3 BGB, the right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health or hygiene if your seal has been removed after delivery.

Complaints / dispute settlement

In accordance with EU Regulation No. 524/2013 and based on EU Directive 2013/11, we as online providers are obliged to inform our customers about the online dispute resolution platform (OS) of the European Commission. The OS platform can be reached at the following Internet address: http://ec.europa.eu/consumers/odr/ . With this platform, consumers have the opportunity to settle online and out of court any disputes arising from the online purchase agreement between them and our company. In this context, we are legally obliged to point you to our e-mail address as follows: mail@spirit-of-om.de

We endeavour to settle any disputes arising from our contract by mutual agreement.
